National Badminton Centre Health & Fitness Club – Terms and Conditions

PART A – TERMS AND CONDITIONS OF MEMBERSHIP

This agreement is an agreement between you and Badminton Association of England Ltd. commencing once you have indicated your acceptance in the Declaration section of this web sign up process.

Membership

Your membership will start on the day you enter into this agreement and referred to hereafter as the “Joining Date”. The Joining Fee is due and payable immediately on execution of the agreement, unless explicitly waived by us (for example, as part of a promotion), and is non-refundable other than in the event of breach or negligence by us.

You will be entitled to all the rights and privileges exercisable for the Type of Membership chosen, subject to your timely payment of the fees and charges set out below and the successful processing of your direct debit instruction.

Fees and Minimum Terms

Fixed term memberships will expire in line with the stated period from the Joining Date, as outlined in your membership type. Upon expiry of your membership, access to all facilities and member benefits will be ceased immediately, until renewal of your membership. You are free to select any membership available whilst outside of your membership.

Memberships payable via a monthly Direct Debit are subject to a minimum six-month period. Members are obligated to pay the initial pro-rata fee, unless explicitly waived by us, followed a minimum of six full monthly payments to cover the six-month period.

Direct Debit payments are collected on the 1st of each month, unless this a non-business day in which it will be collected as close to as reasonably possible.

For the avoidance of doubt, you are obligated to make every Direct Debit Payment regardless of non-attendance, whatever the reason for non-attendance may be. You agree to pay us the monthly membership amount regardless of lack of attendance, or whether there is any temporary interruption in services during the period, foreseen or unforeseen. In circumstances where we are required to close or restrict facilities for any reason, Badminton England are under no obligation to offer a refund for loss of service.

If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any other form of payment is not honoured for whatever reason, you shall not be able to access the facilities until your account is brought up to date.

You agree to advise us promptly of any change to the Members Details provided.

Once you have completed the minimum term, we will automatically continue collecting the Direct Debit Payment Amount every month. Your membership will be extended by one month for each payment (“Renewal Period”). This renewal Direct Debit payment amount may only be amended if we advise you in writing giving not less than one full months’ notice prior to your scheduled DD renewal date.

Cancellation

Once you have completed the minimum term, you may prevent the Automatic Renewal at any time by giving notice to nbc@badmintonengland.co.uk. You must provide a minimum of 30 day’s notice prior to your scheduled Renewal Date). When the final minimum period payment has been taken you should also cancel your Direct Debit mandate directly with your bank.

Under the terms of this agreement, we have no obligation to cancel a membership on request for any members within the minimum agreed term of a membership. We do however reserve the discretionary right to agree to a cancellation request on medical grounds, whereby recommended in the written opinion of a doctor or other suitably qualified medical practitioner.

Freezing

Memberships can be reasonable paused for a maximum three-month period, once in a twelve month period. Grounds for requesting a Membership Freeze include:

Temporary Illness or Injury: in the event of a temporary illness, injury, or medical condition which in the written opinion of a doctor or other suitably qualified medical practitioner prohibits exercise for a period of time.

Extended time away: if you are spending an extended amount of time (over a month) away from the area of the gym.

Should you have any other circumstances that you reasonably feel constitute a membership freeze, then you should contact nbc@badmintonengland.co.uk. We hold no obligation to accept this, outside of the above reasons, however will consider each case reasonably on its merits.

Please note that Freezes end automatically, and billing will recommence once your Freeze Period has expired.

Part B CENTRE (RULES AND REGULATIONS FOR USING THE CENTRE, FACILITIES AND ACTIVITIES)

All individuals accessing the National Badminton Centre ("Members"), as well as guests and occasional visitors, are required to adhere to the following guidelines. These rules are an integral part of a member’s agreement with us, and their compliance is essential for maintaining the high standards of our Centre's and ensuring that Members, guests, and visitors fully enjoy their Membership benefits.

Non-compliance with the rules or engaging in misconduct may result in expulsion or denial of access. We retain the right to terminate and/or suspend membership and access privileges as necessary, with safety being our utmost priority. Our interpretation of the rules holds precedence, and the Manager's decisions are final. Actions may be taken if you or your party violate the rules or, in the Manager's reasonable judgment, behave inappropriately.

We reserve the right to make reasonable amendments to these rules or our individual Centre operational guidelines at any time. Should such changes occur, Members will be given advanced notice through communication within the Centre premises.

Any special measures and operational guidelines (displayed throughout the Centre) supersede others temporarily and are implemented to ensure a safe environment for all, in alignment with best practices for hygiene, cleanliness, Centre operations, team, and Member safety.

Acceptance of an application for Membership at each Centre is at our absolute discretion (although we will exercise our discretion, and in compliance with applicable laws). 

Guests and Visitors

  1. Members are permitted to bring guests (aged eighteen and above) to the Centre under the following conditions: (a) payment of the guest fee is made, and (b) the guest completes a Health Commitment Statement as requested.
  2. Members must always accompany their guests, and the member who brings the guest remains responsible for their conduct while in the Centre.
  3. Members with a "frozen" Membership are not granted access to Centre.
  4. All guests must comply with the Centre's rules.
  5. The Centre team reserves the right to refuse access to guests if the Centre's capacity is high and unable to accommodate them.

Behaviour and Conduct

  1. Ensure that your conduct within or around the Centre is appropriate and does not disrupt or hinder the experience of other Centre members. This includes refraining from using offensive, loud, or abusive language, avoiding threatening behaviour, and refraining from disturbing or harassing other members, guests, visitors, or staff.
  2. The NBC is committed to ensuring that we are a facility which is inclusive and welcoming of diversity, we aim to create an environment free from discrimination or harassment.   3. Do not bring, use, or be under the influence of drugs or illegal substances.
  1. Complaints should be communicated privately to a member of the Centre’s management.
  1. Smoking is prohibited in any area of the Centre including the use of e-cigarettes or similar devices. 
  1. You must be always dressed in suitable attire when on Centre premises, and appropriate exercise clothing is required whilst exercising in the Centre.

Health and Safety

1.     Fire exits, which are clearly marked, are there in the interests of safety and you must not interfere with or obstruct fire doors for any reason. 

2.     You must read the Health & Safety notices posted outside any equipment or facility rooms in the Centre and comply with the recommendations. 

3.     You must comply with any reasonable requests made by the members of staff in relation to matters of Health and Safety. 

4.     We reserve the right to amend the Centre Rules at any time and if necessary, without notice to you. We will always attempt to notify you of any changes, especially in relation to Health and Safety


You may not undertake physical activity or use the saunas while under the influence of alcohol, anticoagulants, antihistamines, beta-blockers, narcotics, or tranquilisers. If you have high or low blood pressure, heart disease, cardiac irregularities, asthma and/or diabetes, or if you are pregnant, you should consult your doctor prior to using our facilities. 

General

  1. Members are expected to respect the personal space of others while in our Centre.
  2. The opening hours for the centre will be clearly displayed at the Centre and on our website.
  3. The sauna will close 15 minutes before the advertised closing time to allow members time to change. All other facilities, including the gym floor, will remain open until the advertised closing time.
  4. Pets, except for guide or assistance dogs, are not permitted on the Centre premises.
  5. We reserve the right to provide potential members and other individuals with a trial access to the facilities.

6.      Junior members and guests under the age of 8 may change in either male or female changing rooms under adult supervision.

  1. If anyone has any concerns regarding the welfare and wellbeing of a child or adult, they can share these concerns with the General and/or Operations Manager. Details on safeguarding policies and procedure can be found at https://www.badmintonengland.co.uk/about-us/safeguarding/

Gym Use

  1. Prior to using any fitness facilities, you are required to complete a Health Commitment Statement as requested by us. 
  1. It is advisable to seek instruction before using equipment with which you are unfamiliar.
  1. Please ensure you wear appropriate, clean exercise clothing and shoes while exercising.
  1. After using equipment, it is important to wipe it down.
  1. Please arrive at the Centre five minutes before any scheduled personal training or induction appointments. We reserve the right to refuse to re-book appointments if there are repeated cancellations or failures to keep appointments for services and/or exercise programs.
  1. Gym users are kindly requested to store their belongings in the lockers provided and refrain from bringing them onto the gym floor.

Group Exercise Classes

  1. Classes can be booked up to 7 days in advance either online or via reception by Gym and Badminton Members
  2. You must pre-book classes to ensure your participation in them. 
  1. If you can no longer attend a pre-booked class, you must cancel your booking by calling the Centre or cancelling online via our App or Website giving at least 24 hour’s notice.
  1. If you book a class and fail to attend without cancelling correctly (as above) three times in any 30-day period, then your class booking will be reviewed.
  1. Class timetables and instructors are subject to change from time to time without notice. 
  1. You are requested not to open the doors while a class is in progress, as this may interfere with the operation of the air-conditioning system and disrupt other participants. 
  1. To avoid disturbing classes, you are requested to arrive in good time. Classes will commence at the scheduled time. Entrance to classes after the class start time may be refused. Any spaces available at the start time will be offered to those present and waiting. 
  1. Where, in the opinion of an instructor, a class is overcrowded, the instructor may restrict the number of attendees in the class. 
  1. Any member of staff may, at any time, ask you to leave a class or activity if you are jeopardizing the safety or enjoyment of others. 

Badminton

  1. Courts can be booked up to 7 days in advance either online or via reception by Gym and Badminton Members
  2. Any non-members must pay the appropriate badminton guest fee.
  3. Appropriate indoor badminton shoes (non-marking) must be worn when using the courts.
  4. We do not allow cancellations; you can reschedule your booking with a minimum of 48 hours’ notice due to any extenuating circumstances by emailing us at nbc@badmintonengland.co.uk
  5. Out of respect for other players please arrive no more than 5 minutes before your scheduled court booking and finish promptly.
  6. Children under the age of eleven must be accompanied by a responsible adult.

Junior Gym/Studio Use

  1. The parent/career agrees to ensure that each Junior Member adheres to the club rules, both when present and if the junior member is attending alone.
  2. All Junior gym members must complete a gym induction prior to first use of the gyms.
  3. Junior members 16 years old and over can use both gyms at any time once an induction has been completed
  4. Junior members aged 14 & 15 must be always accompanied by an adult when visiting the gym.
  5. Junior members aged 14& 15 can only use the Perform gym when physically accompanied by an adult member
  6. Junior members cannot book and attend our group exercise classes.

Lockers

  1. Lockers are subject to availability. 
  1. The National Badminton Centre does not undertake that use of a locker will guarantee that no theft of or damage to your property will occur. We will not accept any liability in relation to locker thefts unless they result from our negligence. You should check that your household contents or other insurance policy protects you against any risk of theft. 
  1. Lockers may only be used for the purposes of keeping gym kit, toiletries, and the clothing that you were wearing when you came to the Centre. The keeping of any other items in the Centre’s lockers is prohibited. If National Badminton Centre staff have reasonable grounds to suspect that a locker is being used in breach of this Rule, we reserve the right to open the locker in question (by force if necessary) and remove (and dispose of) any offending items. 
  1. Use of a locker while not on Centre premises is prohibited. If you leave your belongings overnight in a locker The National Badminton Centre reserves the right to open the locker (by force if necessary) and remove (and dispose of) your belongings. 
  1. Your belongings, so removed, will be available for collection from the Centre’s Reception for a period of thirty (30) days. If you do not collect your belongings within thirty (30) days, your belongings may be donated to charity or otherwise disposed of. 

Car Parking and Mobility

  1. Our car park may only be used by Members, guests, and visitors while they are on Centre premises. You may not leave your car in our car parks at any other time.
  2. You must be a Blue Badge holder to park in the accessible bays in our car park. 
  1. You may not bring any electronic scooters or vehicles into the Centre under any circumstances. For the avoidance of doubt, you may not use the Centre’s electricity to charge your electronic scooter or vehicle.

Photography and Video

1.      Filming and photography take place in our Centre from time to time. If you do not wish your image to be used in any filming or photography, please inform a member of the NBC Team. 

2.      Under no circumstances will any photography or video be allowed in any of the changing facilities, toilets, or saunas.

3.      You must not take photos or video of any children under eighteen other than your own. 

4.      You must not take photographs or videos of anyone without their consent. 

5.      If you have any concerns about someone taking photos or any other form of image recording, please speak to a member of the NBC Team.

6.      If we believe that you may have taken a photo or video footage in a restricted area or have concerns with you taking photo or video footage elsewhere in the Centre, we may ask you to show us the images taken and ask you to delete them if appropriate.  

Data Protection

  1. We will deal with all information we hold about you in line with our privacy policy which you can get from our website  https://www.badmintonengland.co.uk/privacy-notice/  If you want to know what information we hold about you, or you want us to correct any information we hold about you, the appropriate procedures are set out in our privacy policy.
